When Trust Records Fall Short

A bank asks who has authority to act for a trust. A successor trustee needs to prove proper appointment. Most teams dig through filing cabinets and email threads for a trust agreement amended three times since signing.

Trust governance produces constant change — trustees resign, protectors exercise powers, beneficiaries vest, instruments get restated. Lextree’s Trust Governance module tracks every trustee, protector, beneficiary, and amendment. Not trust accounting software or a drafting tool. Prove Trustee Authority

Each trustee appointment record captures the effective date, source of authority, and supporting documents. Sources include the trust instrument, an amendment, a court order, or a trust protector action. When service ends — resignation, removal, term expiration, death, incapacity — the record captures the date, reason, and evidence. Bond reminders arrive at 90, 60, and 30 days before expiration.

Separate records distinguish co-trustees from successor trustees, investment trustees, distribution trustees, and administrative trustees. Split trusteeships document specific powers for each role. Successor trustees line up in sequence, so the path is clear before you need it. Protectors and Beneficiaries

Trust protectors hold oversight authority without being trustees. Powers vary from trust to trust: one may remove and appoint trustees, another only approves amendments, a third may change situs. Each power appears as a structured field — modifying terms, changing situs, removing or appointing trustees, approving fees, adjusting beneficiaries, directing distributions. Search across trusts to find every protector with a given power.

Beneficiary records document who holds what interest in each trust. Each captures the interest type (income, remainder, contingent, discretionary, charitable), percentage if fixed, and distribution details. Vesting events trigger automatic reminders so distribution ages and vesting dates never slip. Spendthrift protections, Crummey withdrawal rights, and withdrawal amounts appear as structured fields.

The Amendment Record

Trust instruments evolve through amendments, restatements, decanting, court modifications, and nonjudicial settlements. Amendments modify provisions; restatements replace the full document while preserving the original trust; decanting transfers assets to a new trust with different terms.

Lextree tracks each modification with an effective date, execution date, sequential number, and approving parties. Court-ordered modifications include case numbers and order dates. Every amendment document attaches to its record. Review the original plus each modification in sequence to understand the current terms.

Trusts in Context

Trusts in Lextree are legal entities. Every trust benefits from Legal Entities for state registrations, formation documents, and periodic filings. Taxes handles trust tax filings (Form 1041, state fiduciary returns). Ownership tracks relationships when a trust owns other entities.

Does Lextree replace a trust accounting system?
No. Lextree tracks the governance side of a trust — trustees, protectors, beneficiaries, trust instruments, amendments, and key dates. For day-to-day accounting of trust assets and distributions, customers continue to use their fiduciary accounting platform.
Can we track trustee succession and protector changes over time?
Yes. Each trustee, successor trustee, and trust protector appointment is its own record with start and end dates. The Timeline preserves who held each role on any given date — critical when historical trustee actions come under review.
How does Lextree handle beneficiary information sensitivity?
Beneficiary records can be restricted at the list level — only users with explicit access see them, even users who have access to the broader trust record. Access can be granted per-trust or per-role, with every view and change logged.
Can we connect a trust to the entities it owns?
Yes. A trust that holds membership interests, shares, or other equity is recorded in the Ownership module the same way any other holder is. The trust’s governance record and its ownership record share the same entity, with full audit history across both.
Does this support multi-jurisdictional or offshore trust structures?
Yes. Trusts can carry their governing jurisdiction, situs, and any applicable forum selection. Multi-trust families with mixed onshore and offshore structures are tracked side by side without forcing each jurisdiction into a separate system.
